Nepal Can Now Declare Bhote Koshi Flood Missing Dead Without a Court

Names of the missing go on a public list for seven days of claims and objections before the government can declare death, the law minister says.

Nepal Police put the death toll at 1,457 as of Saturday, October 10, with thousands still missing, Nepalnews.com and Pardafas reported. A day earlier, on Friday, October 9, President Ramchandra Paudel signed an ordinance that lets the government declare flood missing people dead without going to court, easing the legal path to inheritance, insurance and relief for families still waiting more than six weeks after the disaster.

The flood struck on Wednesday, August 26, when an ice avalanche sent a massive flood down the Bhote Koshi and Trishuli river corridor, an opinion piece in OnlineKhabar English said. The ordinance amends several of Nepal's disaster related laws specifically because of the Bhote Koshi flood, the government said, according to OnlineKhabar. Under the old rule, a missing person could only be declared dead after 12 years under Nepal's civil code, or through a separate court petition for disaster deaths, Law Minister Sobita Gautam said, according to OnlineKhabar. Taking each case to court was impractical when so many people vanished at once, she said.

Under the new process, a local government and the district disaster management committee recommend names of the missing. The list then goes through a seven day public window in which anyone can file a claim or an objection. After that, the executive committee recommends and the government of Nepal declares the death, with no separate court ruling needed, Gautam said. "Death registration, inheritance, property transfer, insurance, relief and other legal processes will become easier," she said, OnlineKhabar reported.

Separately, 269 children have lost one or both parents in the disaster, Ekantipur reported. A tracking website built by a Hyderabad based engineer is helping families track more than 600 missing flood victims, The Week reported.

What the coverage missed

When the cabinet recommended the ordinance on Wednesday, October 7, government spokesperson Sasmit Pokharel said it would cut the 12 year wait to "around 45 days", OnlineKhabar English reported. OnlineKhabar's account of the law minister's briefing on the signed ordinance names a seven day public claims window and gives no 45 day figure. Nepal Wire has not read the ordinance text and cannot yet say how long the whole process takes.

The ordinance also sets up a separate mechanism letting district disaster committees direct state agencies to supply stone, gravel, sand and soil for rebuilding damaged roads, bridges and homes, with legal action possible if the instruction is not followed, OnlineKhabar reported.

This is not the first flood in this corridor. The Bhote Koshi valley flooded on July 8, 2025, more than a year before August's disaster, and that earlier destruction did not spur lasting prevention work, an opinion piece in OnlineKhabar English argued.

What we still do not know

How much compensation each family will receive and when payments start, a question for the Ministry of Home Affairs and NDRRMA, Nepal's disaster management authority.

Whether people connected to hydropower project sites reported missing in late August are still part of today's count, a question for Nepal Police and the hydropower companies operating along the corridor.

Whether any government body is reviewing the performance of river monitoring stations in the corridor during the flood, a question for NDRRMA and the Ministry of Energy.

Why it ran today

  • ranking judge 1: ranked #1 with 84/100. Real development since our October 8 piece: President Paudel has now signed the ordinance, OnlineKhabar reports, and Nepal Police put the toll at 1,457 via Nepalnews and Pardafas. Writers must attribute every figure, drop the unverified Hyderabad tracker, confirm the 45 days against the gazette, and flag that the missing count differs (4,720 per Nepal Police vs about 5,000 cited for the ordinance). Weakest dimension is comment friction.
  • ranking judge 2: ranked #1 with 84/100. Confirmed. This is a real development since our October 8 piece: OnlineKhabar reports President Paudel has now signed the ordinance, and Nepal Police put the toll at 1,457 as of 6am October 10, via Nepalnews and Pardafas. It changes families' access to compensation and inheritance this month. The 45 day figure must be checked against the signed text or gazette, the Hyderabad tracker dropped, and the gap between missing counts reported. Weakest dimension is comment friction.

What the desk dug up

  • The pattern. The same Bhote Koshi-Trishuli corridor was hit by a flood roughly 13 months earlier, on July 8, 2025, and no preventive or structural measures followed before the much larger August 26, 2026 disaster that produced today's 1,457 toll. [OnlineKhabar English] [Nepalnews.com explainer]
  • Left out. The ordinance President Paudel signed does more than ease the missing-dead declaration: it also empowers district disaster committees to direct the supply of stone, gravel, sand and soil for rebuilding roads, bridges, housing and public infrastructure, with legal penalties for non-compliance, a provision that is absent from every English-language wire story about the ordinance in this coverage set. [OnlineKhabar (Nepali)]
  • The record. The single Nepali-language primary source fetched for this story describes a 7-day public claim-objection window before the government can declare a missing person dead, not a 45-day period; it also shows the ordinance replaces a general civil-code rule presuming death only after 12 years of absence, or a court petition for disaster deaths, with an administrative declaration requiring no judicial order at all. Judge 1: The ordinance story is real, timely and well sourced in OnlineKhabar. However, the piece mistranslates who declares death, miscounts the weeks, and inflates 'long and complex' into 'years'. It also builds its missed angle on unread pages: a 45 day contrast from an unopened Chosun article, and a missing-count trend that contradicts itself and rests on three 403 pages. One editing pass that cuts the unverified material and sharpens the reader-facing card, hook and trigger makes it publishable.

Judge 2: I confirmed all four edits from the last round. The August 26 date and the place are now in paragraph 2, sourced to the OnlineKhabar English opinion piece, and August 26 checks out as a Wednesday, 44 days before Friday, October 9. The minister's words now read 'said, according to OnlineKhabar', The Week's figure reads as 600 missing flood victims, and the take says 'missing flood victims'. On a full reread the revision added no new unsourced claims or date errors, and the ordinance mechanics match OnlineKhabar Nepali line by line. Two side figures remain unread: the 1,457 toll and the 'Hyderabad based engineer' detail, since The Week's page was never fetched and the sources entry says only 'Hyderabad built website'. Both are attributed to named outlets, and with no revisions left this approval accepts them as they stand.

The complete record, including the advocate, skeptic, red team and defence arguments, is kept by the newsroom.
